1. Heard learned counsel for the petitioner and Mr. Chandra Bhushan Prasad, learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 316(2), 318(1) and 3(5) of the BNS.

3. Learned counsel for the petitioner submits that the Investigating Officer of the case is present in the Court and submits that notice under Section 35 BNSS has been issued to the petitioner yesterday, i.e., 08.10.2025.

4. Learned counsel appearing on behalf of the petitioner submits fairly submits that petitioner has received the notice, as such, for the present, petitioner does not have any apprehension of arrest, hence, seeks permission to withdraw the anticipatory bail application with liberty to file afresh, if need arises.

5. Permission is accorded.

6. Accordingly, the instant anticipatory bail application is dismissed as withdrawn in connection with Jandaha P.S. Case No. 123 of 2025 pending in the Court of learned Chief Judicial Magistrate, Vaishali at Hazipur/Successor Court.

7. The personal appearance of the Investigating Officer of the case is dispensed with.
