JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-11-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 30.06.2018 in connection with Shikarpur P.S.Case No. 230 of 2018 registered under sections 304B, 201/34 of the Indian Penal Code. Petitioner happens to be husband of the deceased and admittedly, deceased died with seven years of her marriage. Furthermore, first information report as well as statement of witnesses disclosed that deceased was subjected to cruelty on account of none fulfillment of illegal demand. The death of deceased is admittedly took place at her matrimonial home and her death was not normal.

Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release

Patna High Court CR. MISC. No.55249 of 2019(3) dt.27-11-2019 2/2 the petitioner on bail. Accordingly, his prayer for bail in connection with Shikarpur P.S.Case No. 230 of 2018, pending in the court of learned Chief Judicial Magistrate, Bettiah, West Champaran stands rejected for present.
