The petitioner apprehends his arrest in a case registered under Sections 409 and 420 of the Indian Penal Code. The Block Development Officer alleged that the then Mukhiya Motiur Rahman, Laxman Singh (the petitioner), the executing agent of the scheme and Ganesh Paswan, the then Panchayat Secretary committed irregularities in execution of a scheme worth Rs. 27,450/-.
The case of the petitioner is that he has executed the scheme in time. Co-accused Motiur Rahman has already been granted anticipatory bail vide order passed in 3585/2012. The scheme was of the year 2000-01 and the enquiry was held in the year 2010.
Considering the facts aforesaid, the above named
Patna High Court Cr.Misc. No.34744 of 2014 (2) dt.18-02-2015 2/2 petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in Karza P.S. Case No. 21/11, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
