The Petitioner apprehends his arrest in connection with Narhat (Sitamarhi) P.S. Case No. 140 of 2015 registered for offences punishable under Sections 341,323,324,307,379,504/34 of the Indian Penal Code.

It is contended that the entire story set up in the first information report appears to be cock & bull story inasmuch as it is clearly stated that, after the alleged assault by the petitioner, the informant became unconscious still he has given a graphic account of the further occurrence. It is further stated that as per allegation, petitioner has assaulted by iron rod, however, though the injury is on the head but simple in nature and, as per the opinion of medical

Patna High Court Cr.Misc. No.18711 of 2016 (2) dt.12-05-2016 2/2 officer, has been caused by sharp cutting weapon. It is further contended that petitioner and the informant are full brothers and there is family dispute. Petitioner's claim that his antecedent is clean.

Having regard to the facts and circumstances of the case, let the petitioner, namely, Yogendra Chauhan be released on bail in the event of arrest/surrender before the Court below within a period of six weeks from today in Narhat (Sitamarhi) P.S. Case No. 140 of 2015, on furnishing bail bond of Rs. 10,000/- (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate-III, Nawada subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of criminal Procedure. (Dr. Ravi Ranjan, J.) ravi/- U T
