The petitioner seeks bail in a case registered for the offence punishable under Section 302 of the Indian Penal Code in connection with Sadar P.S. Case No. 73/2017.
Allegation against the petitioner, wife of the deceased, is of assault the deceased causing his death. Submission of the learned counsel for the petitioner is that F.I.R. itself shows that the occurrence took place due to quarrel and fight between the husband and wife, in which the deceased sustained injuries, but the post-mortem report does not disclose the cause of death. For that, viscera has been preserved. It has been submitted that the petitioner is a lady, who is in custody

Heard learned Additional Public Prosecutor also. Having heard both sides, considering the facts and circumstances of the case, specially the manner of occurrence and also the cause of death, which has not been ascertained and further the petitioner is a lady, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge I, Purnia in connection with Sadar P.S. Case No. 73/2017, corresponding to S.Tr. No. 217/2017, subject to conditions that one of the bailors should be relative of the petitioner and another having sufficient immovable property within the jurisdiction of the court below.
