1. Heard learned Senior counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 191(2), 329(3), 115(2), 118(1), 64(1), 62, 109, 74, 352 and 351(2) of the BNS, 2023.
3. Learned Senior counsel for the petitioners submits
Patna High Court CR. MISC. No.54582 of 2025(2) dt.27-08-2025 2/3 that petitioners are persons with clean antecedent and petitioner nos. 6, 7 and 8 are women and the informant alleges that his niece informed while he was at his shop Indresh Giri has entered the house and is trying to commit rape of her Mami, accordingly, the informant reached his house and saw that victim was half naked and Indresh was inside the house, further alleges that thereafter all the petitioners came and assaulted him and his mother by lathi, danda, brick and stone, further the occurrence took place on account of land dispute.
4. Learned Senior counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that petitioner and the informant belong to the same family and from perusal of the allegation as alleged in the F.I.R., it would manifest that no specific allegation of assault is alleged against the petitioners while allegation against petitioner no. 2 of trying to commit rape is ornamental. It is further submitted that on account of dispute relating to land, the entire family members have been implicated including the female members.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
6. Considering the submissions made by the learned

No.54582 of 2025(2) dt.27-08-2025 3/3 Senior counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Tisiauta P.S. Case No. 43 of 2025 subject to the conditions as laid down under Section 482 (2) of the BNSS.
7. Accordingly, the instant anticipatory bail application is allowed.
