Mr.A.G ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-04-2022 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in registered for the offences punishable under sections 376, 504/34 of the Indian Penal Code.
As per the prosecution case, petitioner being Dewar of the widow informant, committed sexual intercourse with her on the false assurance of marriage as a result of which she became pregnant.
Learned counsel for the petitioner denies the allegation and submits that when the petitioner refused to marry the informant, she became infuriated and lodged this false case. Petitioner has got clean antecedent as stated in paragraph 3 of
Patna High Court CR. MISC. No.66051 of 2021(3) dt.15-04-2022 2/2 the bail petition. Petitioner is in custody since 18.9.2021. Learned counsel for the State opposes the prayer for bail and submits that there is direct and specific allegation against the petitioner that he committed sexual intercourse with the informant on the false assurance of marriage as a result of which she became pregnant. Doctor has also supported the prosecution case.
Considering the nature of accusation and the materials available on the records against the petitioner, his prayer for bail is refused.
