2 The petitioner apprehends his arrest in connection with Ladaniya PS Case No 45 of 2023 corresponding to GR No 343 of 2023 instituted under Sections 272, 273 of the Indian Penal Code and Section 30 (a) of Bihar Prohibition and Excise Act.
3 As per the prosecution case, there is recovery of 1035 liters of illicit liquor from the mango orchard. 4 Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. There is no recovery from his conscious possession. He is neither owner of the mango orchard nor he has any concern with
Patna High Court CR. MISC. No.58430 of 2023(2) dt.20-09-2023 2/2 the seized liquor. Due to village politics, he has been implicated in this case. He bears clean antecedent.
5 Learned APP opposes the prayer for anticipatory bail.
6 Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner shall be released on bail on his furnishing bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge II -cum- Special Judge, Excise Act, Madhubani in connection with Ladaniya PS Case No 45 of 2023 corresponding to GR No 343 of 2023 subject to the conditions as laid down in Section 438 (2) of the Code of Criminal Procedure, 1973.
