The petitioner seeks bail in a case instituted under Section 25(1-b)a, 25(1-A), 26(ii)/35 of the Arms Act. It is alleged that one country made loaded pistol along with four cartridges are said to have been recovered from the possession of the petitioner.

Earlier the bail application of the petitioner was rejected vide Annexure-1 to the present application, taking into account that the petitioner has got criminal antecedents. A report was called for from the trial Court regarding the stage of the case. It has been reported that out of 5 prosecution witnesses, 3 prosecution witnesses have already been examined in

Patna High Court Cr.Misc. No.34218 of 2017 (4) dt.06-12-2017 2/2 this case.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. The same is rejected in connection with Sheohar P.S. Case No. 32/2016, pending in the court of learned C.J.M., Sheohar.

The Trial Court is directed to take all necessary steps to conclude the trial preferably within a period of five months from the date of receipt of production of copy of this order. The District Magistrate, Sheohar and the Superintendent of Police, Sheohar are directed to ensure that the prosecution witnesses are produced in the court on the date fixed by the court below, so that the trial could be concluded within the stipulated period.
