2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Amendment Act.
3. As per prosecution case, 2.750 litres of illicit English liquor has been recovered from a motorcycle.
4. Learned counsel for the petitioner submits that no incriminating material has been recovered from conscious possession of the petitioner and he has been made accused only on suspicion. The name of the petitioner has transpired in this case on the confessional statement of apprehended co-accused person. The petitioner is neither the owner nor the driver of the seized motorcycle. Petitioner claims clean antecedent.
5. Considering the nature of accusation and clean
Patna High Court CR. MISC. No.58117 of 2024(2) dt.18-09-2024 2/2 antecedent of the petitioner, this anticipatory bail is allowed.
6. Accordingly, let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Court-1, Buxar, in connection with Buxar (M) P.S.
