The petitioners, namely, Deena Yadav @ Dina Yadav and Shri Narayan Yadav, apprehend their arrest in a case under Sections 143, 341, 323, 307, 379, 504, 34 of the Indian Penal Code.
Learned counsel for the petitioners seeks permission to withdraw the Anticipatory Bail Petition of petitioner no. 2, namely, Shri Narayan Yadav.
Prayer is allowed.
The Anticipatory Bail Petition of the petitioner no. 2 Shri Narayan Yadav is dismissed as withdrawn. Learned counsel for the petitioners submits that petitioner no. 1, namely, Deena Yadav @ Dina Yadav is alleged to have assaulted Dhaneshari Devi, Marni Devi and Pinki Kumari
Patna High Court Cr.Misc. No.17141 of 2016 (2) dt.13-05-2016 2/2 with iron rod but only scratches were found on their persons. There is a counter-version.
Considering the facts that there is a case and countercase and on account of assault made by the petitioner no. 1 only simple injury is caused, the petitioner no. 1, namely, Deena Yadav @ Dina Yadav, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II, Madhubani in Babubarhi P.S. Case No. 124/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Dilip/- U T
