The petitioner seeks anticipatory bail in connection with Jamalpur P. S. Case No. 146 of 2018, registered for offences punishable under Sections 366A/34 of the Indian Penal Code. Allegation against the petitioner is of kidnapping the minor daughter of the informant.
Submission of the learned counsel for the petitioner is that the girl has been recovered and her statement has been recorded under Section 164 of the Cr. P. C. in which she stated that she had gone with the petitioner with her own sweet will and disclosed that she is aged about 19 years and the Court has assessed his age is 20 years , though the allegations against the
Patna High Court Cr.Misc. No.41500 of 2018 (2) dt.18-07-2018 2/2 petitioner is false and concocted.
Learned A.P.P. opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 25,000/- ( Twenty five thousand) with two sureties of the like amount each in connection with Jamalpur P. S. Case No. 146 of 2018 to the satisfaction of learned Chief Judicial Magistrate, Munger, subject to the conditions laid down under Section 438 ( 2) Cr.P.C. with other that bailors should be local having sufficient immovable property within the jurisdiction of the Court concerned.
