JUSTICE SUDHIR SINGH ORAL ORDER 24-08-2017 Heard learned counsel for the petitioner and learned counsel for the respondents.

The following reliefs have been sought for by the petitioner in the present writ application.

"1. (I) For issuance of direction, order, orders, writ, writs in the nature of mandamus for commanding and compelling the respondents authorities to make payment, the arrear of salary since December, 2004 till the date of retirement i.e., 31.07.2007 as the salary of the petitioner has been withheld in the light of memo no.

dated 18.12.2004 (Annexure-2) issued under

Patna High Court CWJC No.22247 of 2011 (4) dt.24-08-2017 2/2 the signature of District Superintendent of Education-cum-Sub Divisional Education Officer, Jamui (for short D.S.E.)."

Considering the reliefs sought for by the petitioner, the petitioner is directed to file a representation before the respondent no. 2, the Director, Primary Education, Bihar, Patna, for redressal of his grievance within a period of eight weeks. It is submitted by learned counsel for the petitioner that the case of the petitioner is covered by an order passed in C.W.J.C. No. 14158 of 2009 (Ramjee Das Vs. The State of Bihar and Ors.) dated 28.01.2010.

The said representation of the petitioner shall be considered and disposed of in accordance with law by the respondent no. 2 within a period of three months from the date of filing of such representation, specially taking into account the order passed in C.W.J.C. No. 14158 of 2009 dated 28.01.2010. With the aforesaid observations and liberty, the present writ application stands disposed of.
