No doubt, the petitioner is said to have been arrested on the place of occurrence, while he was removing the seized articles but admittedly, the alleged recovery was made from the house of accused, Ajay Yadav who happens to be full brother of the petitioner.

The contention on behalf of the petitioners is that the petitioner is separate from his brother and as a matter of fact, he has been roped in this case because of being brother of co-accused Ajay Yadav.

Considering the aforesaid facts and circumstances as well as submission of the parties and also keeping in mind the

No.10768 of 2015 (2) dt.19-03-2015 period of detention of the petitioner in jail custody as well as this aspect of the matter that the petitioner does not have any criminal antecedent, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Natwar P.S.
