The petitioner in the present case is seeking regular bail in connection with Udwant Nagar P.S. Case No.483 of 2018 registered for the offence punishable under Sections 302 and 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to village politics. He is in custody since 31.01.2019. Learned APP has opposed the prayer for bail.

Considering that there is a specific allegation of commission of overt act against the petitioner in killing of father of the informant and the injury has been corroborated from the

Patna High Court CR. MISC. No.51851 of 2019(3) dt.20-11-2019 2/2 postmortem report, this Court is not inclined to grant regular bail to the petitioner. This application is dismissed. (Rajeev Ranjan Prasad, J) arvind/- U T
