The petitioner seeks pre-arrest bail in connection with Mojahidpur P.S. Case No. 113 of 2017 registered under Sections 147, 149, 448, 353, 188, 171F and 225A of the Indian Penal Code and Sections 135A and 136 of the Representation of People Act.
It is submitted by the learned counsel for the petitioner that co-accused Mira Devi, Rupa Devi, Ritu Raj Singh, Rinku Kumari and Prashant Kumar have already been granted pre-arrest bail vide different orders passed by different
Patna High Court Cr.Misc. No.43010 of 2018 (2) dt.20-07-2018 Benches of this Court. She has drawn my attention towards one of the orders dated 22.12.2017 passed in Cr. Misc No. 62069 of 2017 whereby co-accused Rinku Kumari and Prashant Kumar have been granted pre-arrest bail by this Court. Learned counsel for the State does not dispute that the case of the petitioner stands on identical footing to that of the other co-accused who have already been granted pre-arrest bail. In view of the submissions made above, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Mojahidpur P.S. Case No. 113 of 2017 subject to the conditions as laid down under Section 438(2) Cr. P.C.
