JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 25-03-2015 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners are accused in connection with S. Tr. No. 241 of 2013 arising out of Siswan P.S. Case No. 173 of 2012 registered under Section 302/34 of the Indian Penal Code. Learned counsel for the petitioners submits that prayer for bail of the petitioners was earlier rejected on merit vide order dated 13.01.2014 passed in Cr. Misc. No. 26021 of 2013 by this Court with observation that if the trial of the petitioners is not concluded within one year, the petitioners would be at liberty to renew their prayer for bail and they are in custody since 15.11.2012. It is further submitted that the case of the petitioners

Patna High Court Cr.Misc. No.6032 of 2015 (2) dt.25-03-2015 has been committed to the court of sessions numbered as Sessions Trial No. 241 of 2012, in which, not a single witness has been examined till today.

Having regard to the facts and the circumstances of the case, the petitioners above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the leaned Additional District Judge-III, Siwan, in connection with S. Tr. No. 241 of 2013 arising out of Siswan P.S. Case No. 173 of 2012.
