The petitioner seeks bail in a case registered for offences punishable under Sections 30 and 41 of the Bihar Prohibition and Excise Act, 2016.
It is contended that, as per allegation, 620 liters of country made liquor were recovered from a vehicle. However, it is submitted that the petitioner was not apprehended from the vehicle or the spot rather he has been apprehended on the basis of information given by the spy of the police. Petitioner claims his antecedent to be clean and he is in custody since 08.06.2017. Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand)
Patna High Court Cr.Misc. No.33702 of 2017() dt.20-07-2017 2/2 with two sureties of the like amount each to the satisfaction of 6th Addl. District & Sessions Judge-cum-Special Excise Judge, Biharsharif, Nalanda in connection with Laheri P.S. Case No.160/17.
Further, if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bond.
