JUSTICE SHIVAJI PANDEY ORAL ORDER 22-09-2020 Heard Mr. Sanjeev Kumar Singh, learned counsel appearing on behalf of the petitioner and Mr. Mritunjay Kumar, AC to AAG 6 for the State through Video Conferencing. In this case, the Work Order was allotted to the petitioner for construction of road from Sitapur Aanandideo Risideo to Paswan Tola at Sitapur village in Basantpur Circle, Birpur in the district of Supaul, vide Agreement No.19 S.B.D./2013-2014, but on account of objection raised by the private landowner, the Circle Officer has stopped the construction

Patna High Court CWJC No.16783 of 2019(2) dt.22-09-2020 2/2 of the road, but as per the petitioner, he has already constructed the road on the government land in 1215 metre and rest land i.e. 1573 metre is the private land. He further submits that he has already invested Rs.35,93,995/- but neither the government has acquired the private land for completion of rest of the road nor entire payment has been made except certain part payment has been made to the petitioner.

Let the petitioner bring all facts to notice by filing a detailed representation to the Chief Engineer-2, Rural Works Department, Bihar, Patna (Respondent No. 3) within four weeks and in tern, the Respondent no. 3 will look into the matter and take decision in accordance with law within twelve weeks thereafter. With the above observation and direction, this petition is disposed of.
