The petitioner seeks bail in Bettiah P.S. Case No. 512 of 2014, registered for the offences punishable under Sections 366A and 34 of the Indian Penal Code.

The mother of the victim made allegation that her daughter went to school on 22.08.2014 but she did not reach the school. She came to know that Sandeep Kumar, Meena Devi, Harendra Mahto, Mantu Mahto and the petitioner kidnapped her daughter. She further alleged that Sandeep Kumar was threatening her to kidnap her daughter.

It is submitted that the victim was having love affairs with Sandeep Kumar. The petitioner is not the family member of Sandeep Kumar. There is no eye-witness of the occurrence. The

Patna High Court Cr.Misc. No.9251 of 2015 (4) dt.01-05-2015 2/2 occurrence of kidnapping took place on 22.08.2014 but the FIR was lodged on 11.09.2014. The informant has not explained the delay in lodging the FIR.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, West Champaran at Bettiah in connection with Bettiah Town P.S. Case no. 512 of 2014.
