The petitioner seeks bail in connection with Ahiyapur P.S. Case No. 32 of 2017 dated 16.01.2017 instituted initially for the offence under Section 392 of the Indian Penal Code but later, Section 395 of the Indian Penal Code was added. Though the petitioner is not named in the F.I.R., but a stolen vehicle is said to have been recovered from his garage. On suspicion, the petitioner was arrested and then he is said to have made his confessional statement.
Similarly situated accused persons, who have been named by other co-accused in their confession, have been granted bail by different Benches of this Court. Some of the orders granting bail to co-accused persons have been annexed with the
Patna High Court Cr.Misc. No.47921 of 2017 (3) dt.28-11-2017 2/2 bail petition.
The petitioner does not bear any criminal antecedent and he is in custody since 16.01.2017.
Taking into account the aforesaid facts, this Court is inclined to grant bail to the petitioner.
The petitioner above named is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No. 32 of 2017.
