The petitioner seeks bail in Buxar (Industrial Area) P.S. case No. 111 of 2019 instituted for the offence under Sections 25(1-B)a, 26 and 35 of the Arms Act and Section 30(A) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

It is submitted by the petitioner's counsel that on account of alleged recovery of four (04) bottles of Indian Made Foreign liquor, the petitioner has been made an accused in the instant case. Prior to the instant case, there is no antecedents of similar nature involving recovery of prohibited liquor. The petitioner is in custody in connection with this case since 03.07.2019.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Additional District & Sessions Judge-II-cum Special Judge (Excise Act) Buxar, in connection with Buxar (Industrial Area) P.S. case No. 111 of 2019 , subject to the following conditions:- (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail bond will be liable to be cancelled.
