2. The petitioner is in custody in a case registered for the offences punishable under Sections 126(2), 115(2), 109(1), 103(1), 3(5) of the BNS 2023.
3. As per allegation in the FIR, it is alleged that petitioner along with other co-accused persons have assaulted the informant and his son after which both of them got deeply injured and during the course of treatment, the informant's son, namely, Niraj Kumar died.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that there is no specific allegation of assault against the
Patna High Court CR. MISC. No.54988 of 2025(3) dt.16-10-2025 2/2 petitioner and the allegation levelled against the petitioner is general and omnibus. He next submits that from perusal of the case diary, it appears that the only allegation against the petitioner is that she was the order giver. He further submits that petitioner is a lady and is in custody since 14.04.2025 and she has got clean antecedent as stated in para-3 of the bail petition.
5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.
6. Considering the above facts and circumstances of the case, submission of learned counsel for the petitioner, let the above named petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st, Class, Madhepura in connection with Srinagar P.S. Case No. 24 of 2025.
