JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-08-2016 The present application has been filed for quashing of the First Information Report of Saharsa Sadar P.S. Case No. 128 of 2016, registered under Section 135 of the Electricity Act, 2003.
It is submitted by the learned counsel for the petitioner that petitioner at earlier stage made complaint with regard to fault in the electric meter, but it was not removed and thereafter, the present case has maliciously been lodge. Moreover, the petitioner has already deposited the entire loss calculated amount including the penalty. It is submitted by the learned counsel for the North Bihar Power Distribution Company Limited, Saharsa that the remedy for the petitioner lies under Section 152 of Electricity Act, 2003 for compounding of the offence.
Patna High Court Cr.Misc. No.18062 of 2016 (2) dt.05-08-2016 It is further submitted by learned counsel for the petitioner that petitioner is ready for filing appropriate application for compounding of the offence provided the same is concluded expeditiously.
Considering the submissions of the parties, the application is disposed of with liberty to the North Bihar Power Distribution Company Limited, Saharsa to conclude the compounding proceeding preferably within three months of making such prayer by the petitioner in writing.
