The petitioner seeks bail in Desri P.S. Case No. 125 of 2017 registered under Sections 385 and 386 of the Indian Penal Code.

The petitioner is said to have given threatening of realisation of extortion by phone to the informant like realisation of extortion from six other shop owners.

It is submitted by learned counsel for the petitioner that the petitioner is not named in the F.I.R. No extortion amount has been disclosed in the F.I.R. As a matter of fact, father of the petitioner is a weaver and the informant is having cloth shop. He

Patna High Court Cr.Misc. No.45929 of 2017 (2) dt.19-09-2017 2/2 has got the cloth woven by his father and did not pay the money and on demand of the said money by the petitioner through his mobile phone, the informant has got him falsely implicated in this case. The petitioner has been languishing in custody since 26.06.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Desri P.S. Case No. 125 of 2017.
