JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 10-05-2016 Heard learned counsel for the petitioner and the learned Addl. Public Prosecutor, appearing on behalf of the State. This application for grant of anticipatory bail arises out of Banka P.S.Case No. 108/2016, disclosing offences under sections 406 and 420 of the Indian Penal Code. The petitioner is the owner of a rice mill. It has been alleged that she has misappropriated 1263.74 quintals of CMR, worth Rs.16,96,705/-. A statement has been made in paragraph 22 of the application that on various dates through Bank drafts, the petitioner has deposited in the account of Bihar State Food and Civil Supplies Corporation a total sum of Rs.15,40,000/-. It has been submitted that considering the nature of allegation, there is no chance of tampering with the evidence, if the petitioner is

Considering the facts and circumstances, this application is allowed.

Let the petitioner, abovenamed, in the event of her arrest/ surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka in Banka P.S.Case No. 108/2016, subject to the conditions as laid down under section 438(2) of the Cr.P.C.

This is subject to the condition that the petitioner shall present herself before the police/ court, as the case may be, as and when required and in the event of failure on her part to appear before the court on two consecutive occasions, her bail bonds shall be liable to be cancelled.
