JUSTICE SANJAY PRIYA ORAL ORDER 07-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Danapur R.P.F. P.S. Case 01 of 2017 instituted for the offence under Section 3 RP (UP) Act of the Indian Penal Code.
It is alleged in the written report that copper wire and some railway items of brass and copper have been stolen by the co-accused persons by breaking open the window of TRD/Depot, Danapur. From the impugned order, it appears that there is no recovery from possession of this petitioner. He has been arrested merely on suspicion.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the
Patna High Court Cr.Misc. No.37388 of 2017 (2) dt.07-08-2017 2/2 petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Magistrate, Bhojpur, Ara, in connection with Danapur R.P.F. Case No. 01 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioner.
