The petitioner is in custody in connection with Barauni Rail P.S. Case No. 52 of 2019 for the offence under Sections 401, 414 of the Indian Penal Code and Sections 137 and 147 of the Indian Railway Act.

Allegation against this petitioner is that he was involved in loot in Capital Express Train and also planning for loot in other train.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 05.05.2019. He further submits that nothing incriminating was seized from the conscious possession of the petitioner and only on the basis of suspicion the petitioner was arrested.

No.51913 of 2019(2) dt.12-09-2019 2/2 Considering the fact that the petitioner has got no criminal antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Railway, Barauni in connection with Barauni Rail P.S. Case No. 52 of 2019.
