JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-04-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 307, 385 and some other minor Sections of the Indian Penal Code.

As per the prosecution case, this petitioner abused and assaulted the brother of informant by iron rod causing serious injuries to him. On alarm, the people gathered and caught the petitioner and handed him over to the police. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case out of old enmity. It is submitted that petitioner has got no concern with the alleged occurrence and as a matter of fact the injured has taken loan from the petitioner and when he went to demand the same he was caught hold and handed over to the

Patna High Court CR. MISC. No.66048 of 2021(3) dt.18-04-2022 2/2 police. Petitioner claims clean antecedent and is in custody since 31.08.2021 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar in connection with Town PS case No.483/2021.
