The petitioner is languishing in custody since 17.01.2015 in a case registered for the offences punishable under Sections 376, 354B of the Indian Penal Code and 3(2)(v) of SC/ST (Prevention of Atrocities) Act.
It is alleged that the informant and her friend Simran were working in the Orchestra Group run by the petitioner and his wife Mamta. It is alleged that the brother of the petitioner Abhinay Kumar Singh ravished the friend of the informant in October, 2014. Though, the petitioner also used to abuse and made attempt to establish forceful physical relationship with the

It is submitted by learned counsel for the petitioner that since the informant after receiving the advance wanted to escape from the Orchestra Group, hence, the present case has been lodged. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. There is no medical report of the informant on the record. Moreover, the thrust the accusation is against the brother of the petitioner. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge - cum- Special Judge, West Champaran at Bettiah in connection with Chanpatiya P.S. Case No. 14 of 2015.
