JUSTICE RAVI RANJAN ORAL ORDER 12-05-2016 Heard learned counsel for the petitioners and the State. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 283, 332, 333, 307, 353, 427, 152, 504 of the Indian Penal Code. It is contended that the petitioners are not named in the FIR, however, their name has come on the basis of recovery of alleged photograph in which the petitioners were found present. It is further contended that several persons, who are not named in the FIR, have already been granted anticipatory bail by different coordinate Benches of this Court vide order dated 29.04.2016 passed in Cr. Misc. No.18396/2016 and order dated 2.05.2016 passed in Cr. Misc. No.16164/2016.
Having regard to the facts and circumstances of the
Patna High Court Cr.Misc. No.18669 of 2016 (2) dt.12-05-2016 2/2 case, let the petitioners, namely, Mukesh Kumar and Lali Yadav be released on bail in the event of their arrest/surrender before the court below within a period of six weeks from today in connection with Dulhin Bazar P.S. Case No.204/2015, on furnishing bail bonds of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Sri Shyamal Kumar, Judicial Magistrate, 1st Class, Danapur, Patna subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
