The petitioner seeks bail in a case registered under section 307 and other allied sections of the Indian Penal Code and 27 of the Arms Act.

The informant named seven persons in the first information report and alleged that they all made indiscriminate firing only to pressurize to withdraws the case lodged against Mumtaz Khan.

Learned counsel for the petitioner submits that no specific allegation of firing is made against the petitioner and nobody was injured in the firing. The petitioner is in jail since 29.11.2014 and he has got one criminal case pending against him that too was lodged later on by the maternal uncle of the

Patna High Court Cr.Misc. No.5742 of 2015 (2) dt.11-02-2015 2/2 informant.

Learned A.P.P. opposed the prayer for bail. On perusal of the record it appears that no specific allegation of firing is made against the petitioner and the petitioner is in jail for more than two months. .

Considering the aforesaid facts, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of C.J.M, Gaya in Bathani P.S. Case no. 63 of 2014.
