The petitioners seek bail in anticipation of their arrest in connection with Kadamkuan P.S. Case No. 131 of 2018 dated 07.03.2018 instituted for the offences under Sections 147, 149, 341, 323, 354, 448, 504 and 379 of the Indian Penal Code.

The petitioners are alleged to have dragged the informant out of her house and in the process she became naked. The petitioners are also alleged to have threatened the informant that she would meet the same fate as her daughter who was earlier gang raped. Learned counsel for the petitioners has submitted that an absolutely false case has been

Patna High Court Cr.Misc. No.42069 of 2018(2) dt.20-07-2018 2/3 instituted against them because of the petitioner no. 1 having earlier lodged a case against the informant of the present case as well as against her brother viz. Chotu vide Kadamkuan P.S. Case No. 60 of 2018 dated 24.01.2018.

Learned counsel for the petitioners has further submitted that the accused persons of the case of the gang rape of the daughter of the informant are not at all related to the petitioners and the reference of that case has only been made in order to add serious color to this case.

The petitioner no. 1 is employed with Syndicate Bank and has brought on record the attendance sheet to show that on the date and time of the occurrence, he was at his place of work. The petitioner no. 2 is a fourth grade employee at a local restaurant.

The petitioners do not have any criminal antecedents.

For the aforestated facts, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned
