====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-08-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State as also the learned counsel for the opposite party no.2.

The petitioner apprehends her arrest in connection with Saharsa Mahila P.S. Case No.44 of 2019 registered under Sections 498(A), 323, 379, 504 and 506/34 of the Indian Penal Code. The accusation is of torturing the opposite party no.2 by her husband and other in-laws for non-fulfillment of the dowry demand of cash Rs.10,00,000/- and 11⁄2 Katha land and removing the opposite party no.2 from the matrimonial house causing assault. At that time, the husband, mother-in-law (petitioner) and 5-6 unknown snatched the gold locket, earring and cash Rs. 3000/- along with

Learned counsel for the petitioner submits that the petitioner is the mother-in-law of the opposite party no.2 and due to dispute in between the opposite party no.2 and her husband, the petitioner has falsely been implicated in this case only to put undue pressure. The petitioner, who is lady, has no criminal antecedent. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of her arrest or surrender by her within six weeks from today, be enlarged on bail on her furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa, in connection with Saharsa Mahila P.S. Case No.44 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
