1. Heard the parties.

2. The petitioner apprehends his arrest in connection with Nokha P.S. Case No. 21 of 2024 dated 05.02.2024 registered under Section 306 of the I.P.C.

3. As per the First Information Report the marriage of informant's daughter namely, Lakshmina Devi (deceased) was solemnized with the petitioner about twenty two years ago and after one year of the marriage the petitioner started assaulting the informant's daughter for which a case was lodged and the same was compromised. Subsequently, on 04.02.2024 the grand daughter of the informant informed him that her mother has committed suicide by hanging herself from the fan.

4. Learned counsel for the petitioner submits that marriage was solemnized way back i.e. about twenty years ago and out of

Patna High Court CR. MISC. No.58639 of 2024(2) dt.11-09-2024 2/2 the wedlock two daughter and one son were born. From the FIR it appears that the victim has committed suicide due to some dispute during the marriage of the petitioner's daughter. The petitioner has not played any active role in abetting suicide.

5. Regard being had to the submission made by the parties, taking into consideration the nature of allegation and the fact that marriage was solemnized about twenty two years ago, I am inclined to grant anticipatory bail to the petitioner.

6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-2, Sasaram, Rohtas in connection with Nokha P.S. Case No. 21 of 2024 subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
