This is an application for bail in connection with Maranchi P.S. Case No. 48 of 2016 registered for the offences punishable under Sections 341, 323, 325, 427, 386, 504 and 506 of the Indian Penal Code.

Allegation as per FIR against the petitioner is that while informant and other persons were working for installation of telephone tower they came and demanded extortion in the name of one co-accused and thereafter they assaulted the informant. Submission of learned counsel for the petitioner is that petitioner has suffered a lot and he is in custody for one year and impugned order shows that trial has not commenced. Heard learned APP also.

No.40638 of 2017 (2) dt.05-09-2017 2/2 Having heard both sides and in view of facts and circumstances, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Barh, in connection with Maranchi P.S. Case No. 48 of 2016, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioner will mark his attendance in the local police station in 1st week of every month till the conclusion of trial, failing which his bail bond shall be cancelled.
