The petitioner is in custody since 10.9.2014 in a case registered for the offence punishable under Section 364 of IPC, later on after recovery of the dead body of the victim sections 302, 201, 120 B IPC were also added.

It is submitted that admittedly no one has seen actual killing of the deceased. The petitioner has been falsely implicated in this case only on the ground that deceased and one Ravi Pal had illicit relationship with the daughter of Anil Pal. The petitioner is only co-villager of Anil Pal who has been granted bail vide Cr. Misc. No. 34024 of 2014 and he has also no criminal antecedent. Considering the facts and circumstances, the above

No.6689 of 2015 (2) dt.26-02-2015 2/2 named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka/court concerned in Belhar P. S. Case No. 52 of 2014 with following conditions:-

1. The petitioner will not indulge himself in similar or any other offence.

2. One of the bailors must be the close relative of the petitioner.

3. The petitioner will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, his bail bond would be liable to be cancelled by the learned Court concerned.
