The petitioner seeks bail in a case instituted for the offences under Sections 379, 411, 413, 414, 506/34 of the Indian Penal Code.

Prosecution allegation, in short, is that motorcycle of the informant was stolen by the accused persons. It has been submitted on behalf of the petitioner that the petitioner is in custody since 14.3.2019 and has got no criminal antecedent. Charge-sheet/prosecution report has been submitted in this case. The petitioner has been made accused due to mistake of fact. The allegation of commission of theft is denied by the petitioner. No stolen property is alleged to have been recovered. Other co-accused has been granted bail vide

Patna High Court CR. MISC. No.52950 of 2019(2) dt.23-08-2019 2/2 Annexure-2 to the present application.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah in connection with Nautan P.S. Case No. 94 of 2019.
