JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-10-2019 This application, for grant of anticipatory bail, arises out of Bidupur P.S. Case No. 253/2018, disclosing offences under Sections 147, 447, 341, 323, 324, 307, 504 and 506 of the Indian Penal Code.

Allegation against the petitioners is of assault to one Santosh Kumar by lathi, when he came to save the informant and there are allegation against other accused persons also. Submission of learned counsel for the petitioners is that impugned order disclosed that injury report of said Santosh Kumar is not available on record and with regard to injury report of one Rajesh Kumar Paswan is concerned, the opinion has been kept reserved and allegation against the petitioners is

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - IV, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 253/2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
