The petitioner seeks bail in a case for the offence punishable under Section 395 of the Indian Penal Code. F.I.R. was lodged against one Akhilesh and four unknown persons for committing theft of a Bolero vehicle and also the mobile phones of the driver and khalasi of the vehicle.
It is submitted that during investigation the investigation officer came to know that Dinesh Sahni and the petitioner have been apprehended in which they have confessed their guilt with regard to the present offence and on that basis the petitioner has been remanded in this case. Nothing has been recovered from his possession. The petitioner has been in custody since 10.10.2014. Chargesheet has already been submitted. There is no chance of tampering with the witnesses. Learned counsel for the State submits that other co-accused who were involved in the offence have
Patna High Court Cr.Misc. No.6091 of 2015 (2) dt.13-02-2015 2/2 confessed their guilt and have stated about participation of the petitioner in the alleged offence and he has also criminal antecedent.
Considering the facts and circumstances of this case, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Vaishali at Hajipur in Jandaha P. S. Case no. 205 of 2014 after framing of charge with the following conditions :
1. One of the bailors will be the close relative of the petitioner.
2. The petitioner will not indulge in similar or in any other offence.
3.
The petitioner will be well represented in the court.
4. In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned. (Amaresh Kumar Lal, J) sudip/- U T
