The petitioner seeks bail in a case registered under Sections 399, 402, 414, 120(B) of the Indian Penal Code and Sections 25(1-B)a, 26(ii), 35 of the Arms Act and 20/22 of N.D.P.S. Act.

Allegation is that one country made pistol along with one live cartridge, three piece of Diazepam Lori injection, 45 pieces of Trika tablet are recovered.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 04.11.2015. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. One country made pistol along with one live cartridge, three piece of Diazepam

Patna High Court CR. MISC. No.56822 of 2019(2) dt.09-09-2019 2/2 Lori injection, 45 pieces of Trika tablet are recovered. There is no compliance of Section 100 of Cr.P.C. In respect of alopathy drugs, no offence under the Drugs and Cosmetics Act is made out. The petitioner has remained in custody approximately for four years.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum-Special Judge, Muzaffarpur in connection with Tr. No.78 of 2016 arising out of Baruraj P.S. case No.133 of 2015.
