JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-08-2017 The petitioner seeks regular bail in connection with Dumra P.S. Case No. 314 of 2015, registered for offences punishable under Sections 394 of Indian Penal Code and Section 27 of Arms Act.

Allegation against the petitioner that he along with other co-accused persons fired on the informant causing injury to him and also snatched away Rs. 12,00,000/- It has been submitted on behalf of the petitioner that he is not named in the F.I.R his name transpired on the confessional statement of co-accused and except that there is nothing against the petitioner. It has also been submitted that in his knowledge, there was only two cases pending against the petitioner and about other cases, he has know knowledge. Further petitioner has been

Learned counsel for the State opposed the prayer for bail and submitted that soon before the occurrence, petitioner was seen at the place of occurrence. Further he has suppressed the fact with regard to criminal antecedents as he has one more case pending against him.

Having heard both sides, considering the fact and circumstances of the case and nature of allegation, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.

However, the petitioner may renew his prayer for bail after framing of charge in this case.
