2. Permission is accorded.

3 . This bail petition of petitioner No. 1 is dismissed as withdrawn .

4. Heard learned counsel for the petitioner No. 2 and the State .

5 . Petitioner apprehends arrest in a case registered for the offence punishable under sections 341 , 323 , 504, 307, 325 , 379 and 34 of the Indian Penal Code .

6. As per the prosecution case , informant namely Shivnandan Kumar alleged that on 27.04.2024 at about 1 PM , all the F.I.R. named accused persons including this petitioner armed with various weapons, surrounded informant and assaulted him with iron rod. It is further alleged that when borther of informant came to rescue, then accused persons also assaulted him and snatched gold chain worth Rs. 70,000/- from him and Rs. 13,000/- from informant.

7. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence as alleged. Specific accusation of assault is against other co-accused persons and so far as this petitioner is concerned, he only tried to shoot the informant with three nut but could not succeeded as villagers arrived. There is no allegation of assault is against this petitioner. Petitioner claims clean antecedent. 8 . Learned counsel for the State opposes the bail petition of the petitioner.

9. Considering the aforesaid facts, clean antecedent of petitioner No. 2 and circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioner No. 2, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two
