JUSTICE MADHURESH PRASAD ORAL JUDGMENT Date : 06-10-2018 Writ petition has been filed by the petitioner saying that he had been working on Grade IV post in the office of the SubDivisional Officer, Bhabhua since 01.08.1985. It is submitted that considering the fact that he had been working for such a long time, this Court may issue direction for his regularization as a permanent employee.

Claim of the petitioner has been disputed by the respondents. It has specifically been stated that the appointment of persons working on Grade IV posts were done from the register 30 which was being maintained by the District Magistrate. Appointments have been made as far as back on

Patna High Court CWJC No.14801 of 2014 dt.06-10-2018 2/2 22.11.1995. Neither the petitioner's name figures in the register 30 nor he was considered for appointment in 1995. The writ petition has been filed in the year 2003 and no proof has been placed on record to show that he had been continuously serving on daily wages since 1985. The assertions have been made with reference to the photocopy of the register 30 and the appointment order issued by the office of the District Magistrate on 22.11.1995.

In view of the aforesaid assertions made in the counter affidavit which has not been denied or disputed by filing any rejoinder, the claim of the petitioner does not merit any consideration.

The writ petition is dismissed.
