JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 308 of the Indian Penal Code and under section 27 of the Arms Act.

The prosecution case is that the informant and Devrati Devi were cutting wood and 6 FIR names accused persons along with 4-5 unknown were firing at the blue bulls but, one of the bullets hit the informant, Sugia Devi, and Devrati Devi. It is submitted by the learned counsel for the petitioner that accusation of firing is not specific against the petitioner. Statement has been in paragraph 3 of the petition that the petitioner has no criminal antecedent.

No.20359 of 2016 (2) dt.11-05-2016 2/2 The aforesaid facts constitute grounds for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioners surrender within six weeks from today in connection with Paroo P.S. case No. 03 of 2016 pending in the court of Sri Aditya Kumar, learned JM, 1st class, Muzaffarpur.

This application is disposed of with the aforesaid observation/direction.
