JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30.08.2017 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State and also heard learned counsel for the informant.
Earlier prayer for bail of the petitioner was rejected giving liberty to the petitioner to renew his prayer for bail, if his trial is not concluded within six months. Trial court has reported that altogether, six witnesses have already been examined but learned counsel for the informant pointes out that except I.O almost all prosecution witnesses including doctor have already been examined. The aforesaid submission goes to show that trial of the petitioner is going in full swing.
Patna High Court Cr.Misc. No.32741 of 2017 (3) dt.30-08-2017 Therefore, I am not inclined to release the petitioner on bail and, again, his prayer for bail in connection with Session trial no. 536/2016 arising out of Chhabilapur P.S. Case no. 28/2016 pending in the court of Addl. Sessions Judge I, Nalanda at Biharsharif stands rejected.
However, learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible preferably, within four months from the date of receipt/production of a copy of this order. Let copy of this order be sent to Superintendent of Police, Nalanda at Biharsharif with direction to him to ensure the presence of investigating officer of Chhabilapur P.S. Case no. 28/2016 corresponding to Session trial no. 536/2016 before the Addl. Sessions Judge I, Nalanda at Biharsharif within one month from the date of receipt/production of a copy of this order.
