ABHISHEK REDDY ORAL ORDER 30-04-2024 Learned counsel for the petitioner has stated that pursuant to the order dated 17.02.2023 passed by this Court, the license of the petitioner has been restored and the petitioner is continuing to operate his P.D.S. shop. Learned counsel has stated that the interim order granted by this Court may be made absolute, however, subject to the final result of the criminal case filed against the petitioner.

2. Learned counsel appearing on behalf of the respondents has stated that he has no objection for making the interim order absolute but in case any adverse orders are passed against the petitioner in the criminal case, the authorities may be

Patna High Court CWJC No.14514 of 2022(16) dt.30-04-2024 2/2 given the liberty of taking necessary action in accordance with law and in case it is found that the petitioner has committed any violations of the provisions of the Bihar Targeted Public Distribution System (Control) Order, 2016, the authorities may be permitted to take action in accordance with law.

3. Having regard to the above, the present writ petition stands disposed of. The petitioner shall be allowed to continue running the PDS Shop subject to the condition that if any adverse order is passed against the petitioner in the criminal case pending against him then the authorities are free to take necessary action. During the subsistence of the license if any violations of the Control order are found by the authorities they are free to take necessary action in accordance with law. (A.
