JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 12-08-2015 In compliance of order dated 18.1.2012, a report has been received from the Sub judge IV, Danapur from which it appears that in spite of processes, opposite parties did not examine their witness. Thereafter, case of the defendants was closed and the matter was fixed for argument. It further appears that the defendants, in spite of providing them opportunities, have not commenced their argument.

From the report of the Sub judge, IV, Danapur, I find that the opposite parties are taking time on the dates fixed for argument. In the circumstances, the trial court is directed to proceed ex-parte to decide Title suit no. 172 of 1992, in

Patna High Court MJC No.5686 of 2011 (3) dt.12-08-2015 2/2 case the parties do not commence their argument on the date fixed by the court below.

The contempt petition thus stands closed.
