JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406, 420 of the Indian Penal Code.

The prosecution case, as per written report of Naveen Bhushan, Circle Officer, Mushahari, is that on 27.01.2016 at about 2 P.M. the Sub divisional Officer, Muzaffarpur, East came to participate in a PACS meeting in the premises of Mushahari block and in course of taking round of block campus a boy was found sitting in front of a Xerox shop, who disclosed his name as Rajesh Paswan, the petitioner, and from his possession forms of old age pension scheme and bundle of other documents were found. It is submitted by the learned counsel for the petitioner

Patna High Court Cr.Misc. No.20585 of 2016 (2) dt.13-05-2016 2/2 that the seizure list does not bear the signature of the petitioner. The accusation has been levelled since the petitioner's mother, being Block Pramukh, did not accede to recommendation of the Sub divisional Officer made at the behest of local M.L.A. for providing old age pension to some non deserving person. Statement has been in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Muzaffarpur in connection with Mushahari P.S. Case No. 11 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C.
