Learned counsel for the petitioner submits that in compliance of the order dated 18.02.2022, a supplementary affidavit has been filed rectifying the pleadings made in the bail application.

The petitioner seeks bail in connection with Ladania P.S. Case No. 251 of 2021 instituted for the offences under Sections 272 and 273 of the Indian Penal Code read with Section 30(a) of the Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 18.08.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.65610 of 2021(3) dt.22-02-2022 2/2 allegation is of recovery of 251 litres of liquor from a fourwheeler and the petitioner was arrested while he was attempting to flee and one accused managed to escape.

Learned counsel for the petitioner submits that neither the liquor nor the seized vehicle belongs to the petitioner rather the petitioner was a passer-by who was forcibly implicated by the police showing that he was trying to flee from the place of occurrence.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 18.08.2021, is a person with clean antecedent and chargesheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IIcum-Special Judge, Excise Act, Madhubani in connection with Ladania P.S. Case No. 251 of 2021.
